The Research Of The Legalization Of The Network Broadcast Of Sports Events

The legalization of the network broadcast of sports events is the inevitable requirement of the development of modern sports media.With the development of network broadcast technology,the sports industry has ushered in new opportunities for development.Major media race to seize the broadcasting rights of sports events.However,there are a series of legal problems gradually emerging in the network broadcast of sports events.There exists defectiveness in the legalization of the sports events programs and broadcasting rights of sports events,and part of the sports events network broadcast behaviors are not in the scope of protection of Copyright Law,making the obliges encounter difficulties when safeguarding rights.Due to the lack of effective coordination among the law enforcement departments of the network and the forensics difficulties of network law enforcement,the effect of fighting against the sports events network piracy is very limited.In addition,the lack of standardization of the network broadcast industry and the faint consciousness of the public copyright protection seriously hinder the legalization of the network broadcast of sports events.Based on the practice of the network broadcast of sports events,this thesis defines the meaning of the network broadcast of sports events and the related legal nature from the two aspects including the living broadcast and broadcast and analyses the necessity of its legalization.In this thesis,the author puts forward the corresponding improvement countermeasures from three aspects including legislation,law enforcement and law abiding about the problems existing in the legalization of the network broadcast of sports events,on the basis of drawing lessons from the relevant legal systems in Europe and America.Country should make the appropriate judicial interpretation and clearly stipulate that the sports events programs belong to "the created works that are similar to cinematography".Sports broadcasting rights shall be clearly stipulated by Sports Law,as well as the "radio broadcasting" and the network media shall be included into the scope of protection of Copyright Law.At the same time,we should strengthen the unity and coordination among the law enforcement departments of the network,improve the corresponding technology level,and sternly crack down on the piracy of sports events.The intellectual property rights protection alliance of Internet sports should set up the articles of association,strengthen its own normalization,and meanwhile give more publicity and education to the public copyright protection.
