Legal Research On Labor Law Supervision Of Trade Unions In China

Labor supervision system in China is one of the important contents of labor and legal supervision system,but also a relatively mature system.While,China's national conditions lead to unions can not always be in a real social standard state.At the same time,with the development of economy and the change of social environment,the interests of both sides of labor relations,labor conflicts have become increasingly prominent,increasing disputes,trade unions must actively safeguard and protect the interests of workers.Thus this article through four parts make an analysis on labor supervision system:The first part explores the labor supervision system of trade union from jurisprudence,and determines the legal nature of trade union supervision through the theory of legal philosophy,so as to evaluate its legal value in our country's law.The second part discusses the scope of the labor supervision of the trade union,mainly to solve the problem of whether the trade unions should supervise the government and the relationship between labor supervision and labor inspection.The third part,mainly for the trade union supervision in the implementation of the contents of the content of the operation to be raised,and give the views and suggestions.Then,explore the construction of a reasonable and efficient mode of operation.The fourth part,through the investigation of the effectiveness of supervision,learn from the relevant system outside the domain,it is recommended that we should establish employers,governments and trade unions supporting legal liability and relief system,from the legal source to protect the rights and interests of workers.
