Study On Transactional Bribery

The concept of transactional bribery crime is put forward from the "Opinions on Several Issues Concerning the Application of Law in Bribery Criminal Cases",but the effect of "opinions" is controversial and whether it can deal with bribery crime directly is questionable.Moreover,the "Opinions" provides that the main types of transactional bribery crime is not comprehensive,I try to add it.In addition,there is a lot of normative term in "Opinions",such as "preferential price","market price","transaction time" and other concepts need to be accurately defined.The paper is divided into four parts.The first part is about the concept of transactional bribery crime,the effection of"Opinions",and the supplement of the main types of transactional bribery crime.The second part is based on Zhang Hongwei case,lists the disputed points that are prone to appear when constituting a transactional bribery crime.The third part is the focus of this article,divided into two chapters.The first chapter focuses on the price factors in the dispute and the other focuses on other important factors in the dispute.The fourth part is the addition to the transaction-type bribery crime types,I point out the difficult points that exist in the crime constitutes.
