Research On Administrative Avoidance System Under The Perspective Of Administration

This paper starts with the basic theories of administrative avoidance system,then analysis the characteristics and the classification of administrative avoidance system.Combined with the current situation of administrative avoidance system of China,analysis the reasons of the current situation.At last,put forward the countermeasures to promote the system of administrative avoidance system of China.There are four chapters in this paper.Chapter 1:The theoretical basis of the administrative evasion system consists of three parts:the general situation of the administrative evasion system and the connotation of the administrative evasion system.The first part mainly expounds the general situation of administrative evasion,and the emergence and development of any system are based on certain theoretical basis.Without the support of the theoretical basis,the system will become the water of the passive and the avoidance system is the same.The administrative evasion system is derived from the British"natural justice" principle and the "due process" principle of the United States.And China's administration according to law is the inevitable requirement of the development of administrative evasion system.The second and the third part respectively discuss the characteristics of the administrative evasion system of the administrative evasion system and the classification of the administrative evasion system.Chapter 2:The current situation of China's administrative evasion system.Combined with China's current regulations on administrative evasion laws and regulations,analyzes the current situation of China's administrative evasion system,and concludes that the existing problems of administrative avoidance system in our country are:avoidance is not enough norms;the current norms are too scattered;the scope of application is too narrow and so on six issues.Chapter 3:Analysis of the causes of the problems in the administrative evasion system of our country.From the previous chapter,the author analyzes the causes of these problems,including four aspects:the special social environment,the lack of procedural consciousness,relative lack of procedural rights awareness,to avoid the lack of supervision system.Chapter 4:Countermeasures to promote administrative evasion system in China.According to the main legal defects of administrative evasion,the author puts forward some measures to perfect the administrative evasion system in our country,such as clearly stipulating the reasons of the administrative evasion system,clarifying the specific situation,avoiding the scope of the subject,improving the procedural requirements,clarifying the legal consequences,Regulations,the establishment of supervision mechanism,improve the relief mechanism,improve the quality of law enforcement officers themselves,increase the relative rights of people awareness,clear rights relative to the protection procedures,the establishment of judicial evasion system.
