On The Effect Of Defective Resolutions Of The General Assembly Of Condominium Owners

There was not any discussion mechanism in our country's traditional community.However,nowadays,apartment has became the mainstream of living pattern.Resolutions of the general assembly of condominium owners plays an important role in ensuring the implementation of the system of proprietors'autonomy and determining their own ways of living.Therefore,it is necessary for us to erect the rules of the resolutions.Although according to Article 78 of the property law of our country,the revocable mechanism of the resolutions has been erected,its content is too simple and it is necessary to highlight the impotance of the problem.This paper intends to introduce the relevant cases and problems to analyse the theoretical basis of the resolutions,the rules of effect of resolutions.The whole thesis can be divided into four parts.The first part is the introduction of the thesis,there is a complex case in it.By using the case,we highlight the value of the research.In the second part,the nature of the resolutions of the general assembly of condominium owners is studied.Through the analysis of several theories,this part clarifies the nature of the resolution of the general assembly of condominium owners.The third part discusses the different effects of the different types of defects on the effectiveness of the resolution and the consideration of the validity of the resolution.As the last part of the full text,the fourth part is the answer of the problems raised in the paper,and it is also the summary of the paper.
