The Analysis And Countermeasures Of Current Situation Of China's Telecommunication Network Fraud

In recent years,telecommunications fraud has been rampant in China,which deeply threatens the interest of the masses.In August 2016,the death of three college students caused by fraud had a very bad effect on our society.Therefore,the purpose of this study is to explose the season of fraud governance failure through analysis of the status quo of china ' s telecommunications fraud governance and its existing difficulties.Hopefully,this study can put forward source corresponding countermeasures and suggestions to solove the problem of telecommunicationsfraud.With holistic governance theory as a research tool,and a combination of literature research method,case analysis method and comparative analysis method as the research method,the study gives a definition of telecommunications network fraud and introduces 48 types of common telecommunications network fraud.Also,this study introduces the theory of holistic governance and explose the feasibility of the theory.Based on the current status of the telecommunications network fraud governance in our country,the study finds out that the main feature of this kind of fraud is the large number of cases,tremendous loss of its victims,various types and means of crime,wide coverage and a huge gray industrial chain surrounding it.Through analysis of the status quo of governance based on the current telecommunications fraud network governance,governance effectiveness and management of the overall situation,the study points out that the current telecommunications network fraud governance dilemma of our country mainly includes four aspects:The first one is multiple governing subject and fragmented governance responsibilities;The second one is the inadequate enterprise and the social responsibility implementation.The third one is dispersed management regions and ineffective cooperation between departments.The fourth one is weak govermance of criminal acts,etc.The main causes of governance dilemma of telecommunications network fraud in our country include the following points:First,the relevant laws and regulations are not perfect;Second,the network,telecommunications,banking and other supply sides have a weak sense of responsibility and a fuzzy value goal.Thirdly,the governance of telecommunications network fraud is fragmented,failing to form a holistic governance mechanism.Fourthly,the technology used in management of telecommunication network fraud is out fo date.According to these problems puts forward the following countermeasures,including:one,establishment of an integrated system of laws and regulations,including criminal laws administrative laws and regulations,local legislation and management of telecommunications network fraud legislation;two,construction of overall governance mechanish for telecommunications network fraud across regions and departments.Three,the construction of early warning and control of telecommunications network fraud and security system;four,construction of rapid and strong response to combat system;five,construction management of telecommunications network fraud;six,the introduction of other social subjects and the construction of cooperation mechanism of industry control methods to integrate the social resources to improve the governance of telecommunications network fraud.Hopefully,the above six measures can help to jointly build the integrity of the telecommunications network fraud governance system.
