The Mechanism Research Of Chinese People's Juror Attend System

The jury system is a typical form of democracy in modern common people directly involved in the judicial activities.It is a judicial system that the national judicial organs absorbs people to attend.Jury system plays a vital role in the process of democracy and the rule of law in the world,and the system of people's jurors in our country is also making progress in history.In 2015,the Supreme People's court and the Ministry of justice formulated the "Pilot scheme for the reform of the people's jurors system ",and "the-measures",which defined the basic principles of the reform of the system of people's jurors and specific requirements,and put forward a series of reform measures,with the deepening of the the reform of judicial system in China,however,the people's jurors system in China based on the reform remains to be further improved.In this paper,based on the jury trial practice of Chengguan District People's Court of Lanzhou City,the author will sum up practical problems and analyze the reasons,study the jury system operation rules and experience abroad,propose the idea of perfecting our people's jurors trial mechanism,in order to make the operation of the system more scientific and reasonable.This paper is divided into four parts.The first chapter is the basic theory of the jury system,first introduces the origin and development of the system and the people's jurors system in our country,and then mainly discusses the necessity to implement the people's jurors system in our country,the value orientation of the people's jurors system.The second chapter is the analysis of the survey data in Chengguan District People's Court of Lanzhou City,the existing problems are found through the analysis of the survey data,then combined with the actual situation analyses the causes of such problems.The third chapter mainly introduces the operating conditions of the typical countries,and summarizes the experience of foreign countries for reference,to provide reference for the design of the people's jurors system in China.The fourth chapter puts forward to perfect the people's jury trial mechanism is proposed,including improving the legal status of the people's jurors system,perfecting selection procedures and trial procedures,establishing differentiated trial separation mechanism in the allocation of authority etc.
