The Study On Patent Protection Mode Of Computer Software

The twenty-first Century is the age of the Internet,using almost any field cannot do without computer,so as to constitute a part of the computer,the use of computer software is becoming more and more popular,and the protection of it is also extremely important.At first,our country didn't know enough about its essential characteristics,and regarded it as "works" to protect copyright.But along with the technical and functional characteristics of it is becoming increasingly prominent,the copyright protection mode of the problems constantly appeared,people began to feel this kind of protection and the protection of computer software is not very good,but the patent law is the better choice.The text consists of four parts.In the first part,the concept of computer software and program is defined and its essential characteristics are expounded.Secondly,it introduces several current protection modes of computer software,and points out the necessity of patent law protection mode by explaining the shortcomings of other protection modes and the advantages of patent law protection mode.The second part briefly introduces the development process of the computer software patent law protection in the United States,Europe and Japan and other countries and regions,and then summarizes the relevant laws and regulations,and summarizes its reference significance to our country.The third part analyzes the appropriateness and feasibility of the patentability of computer software in our country according to the current legal system of our country.The fourth part,according to the present situation of our country,combined with the experience of foreign software power,from our current relevant legal provisions and specific operational point of view,I propose some legislative suggestions.
