Medical Cosmetology Tort Legal Issues Research

Medical cosmetology is becoming a fashionable trend,which provides a new way for women to pursue perfection.With the power of medical technology,now double eyelid surgery,rhinoplasty,light wave beauty and so on is just a small operation,so many people flock.Facing the huge market demand of consumption,a large number of medical cosmetology institutions emerged.At the same time,it is necessary to note that due to a variety of medical beauty institutions,the quality of medical beauty this windfall industry has brought infinite hidden dangers.As a kind of medical behavior,medical cosmetology behavior in making people "become beautiful" when there is a greater risk,resulting in the increasing number of disputes,every day can see a large number of medical beauty disputes to court.However,due to the lag of law,on the one hand,there is not uniform legal application and vague legal principles in dealing with such disputes,and there is a legal vacancy and an awkward situation which can not be depended on,so the result of a large number of cases in judicial practice is unsatisfactory.In the last term,it will have a negative impact on social stability and judicial credibility,so there is a great space for research on medical cosmetology disputes.In the first part,this paper gives the conception and nature of medical cosmetology behavior by comparing the definition,and locates the nature of medical cosmetology behavior as medical behavior.Then,combining with the relevant content of medical damage liability,this paper probes into the conception,nature and type of medical cosmetology tort,and gives some opinions on the relevant conceptual definition,combining with the viewpoint of the present theory.The second part adopts the method of empirical analysis to define the medical beauty dispute within the scope of tort liability,and it can solve the problem better by applying the law of tort liability.The third part discusses the imputation principle of medical cosmetology tort,and considers that the more rigorous imputation principle should be applied.The fourth part discusses the damage compensation system of medical cosmetology tort,and gives the perfect suggestion.
