Survey And Analysis On The Conflicts Of Using Sea Areas In Jinpu New Area's Determining The Rights To Using Sea Area

Sea areas contain rich resources. China has always attached great importance to the exploitation and utilization of sea areas. Clear determination of sea areas rights is the precondition and basis for the exploitation and utilization of sea areas, and rapid economic development for sea areas. The Law on the Administration of the Use of Sea Areas of People's Republic of China issued in 2002 provides the legal basis for the administration of sea areas in China, and promotes the work of determining sea areas rights to ascend a new step. Since 2012, China has conducted a new round of determining the rights of sea areas and introduced a unified registration system for the rights of sea areas, in order to further regulate the management and use of sea areas and promote the registration of determining sea areas rights.Jinpu New Area has actively promoted the standardization, systematization and scientization of the management of sea areas and made significant progress. On the other hand, the New Area has also encountered some tough problems in the process of determining sea areas rights. For instance, the registration of determining rights of sea areas includes categories such as initial registration, change of registration and cancellation of registration. In the process of determining the rights, different categories would face different types of contradictions, which are usually diversified and complicated.Based on domestic and foreign literature review and the day-to-day work, the author found that the conflicts of using sea areas have some regularity and triggers. In the process of determining rights, if these triggers could be understood, analyzed and solved through different methods, then the contradiction of using sea areas could be solved more easily, and the work of determining rights of sea areas in the New Area could be conducted more efficiently.In this paper, a large number of first-hand materials were obtained through the way of questionnaires and interviews, the understanding was deepened in aspects of the basic information, categories and procedure of determining sea areas rights, and contradiction of using sea areas. Through a comprehensive analysis of the use of sea areas in Jinpu New Area and its ten street offices bordered with sea, the author analyzed the data and made comparisons for categories and causes of the conflicts of using sea areas. On the basis of a large number of data analysis and the information gained from interviews, the author summarized the causes of the conflicts of using sea areas in Jinpu New Area, proposed reasonable suggestion to solve the conflicts, and provided some advice and suggestion regarding how to improve the management of sea areas, in the hope of inputting some value to determining the rights of sea areas and solving the conflicts of using sea areas for the New Area and counties.
