Criminal miscarriage as a historical subject,concerned widely in many countries.In recent years,with the social and economic development in our country,trend of criminal misjudged cases have become more critical.Such as Zhao Zuohai and She Xianglin,these were ordinary people,because they have been wronged,which became a familiar name in the community.Therefore,it is necessary to study our country's prevention mechanisms of criminal miscarriage,especially the study of mechanism for procuratorial organs to prevent criminal miscarriage.Prosecutors as key organs of criminal justice,the development of it can lead to criminal miscarriage,or can help develop the criminal miscarriage.If we can establish reasonable precaution mechanism in procuratorial process,then the misjudged criminal case number must be reduced to a large extent.Based on the analysis of misjudged criminal cases and the theory and practice of,this article will attempt to define and analyze the misjudged criminal from four parts,to find out the reasons to offer some suggestions for criminal miscarriage prevention mechanism of the procuratorial organs in China :Part ?: I will firstly define the concept of criminal miscarriage,guaranteeing talk it based on the unique concept in full-text.Then analyze the causes and effects of criminal miscarriage to facilitate following discussion sections.Part ?: Analyze the defection on China's procuratorial organs about the criminal miscarriage,including both legislative and practical aspects.Part ?: On the Analyzing preventive measures for the criminal miscarriage in common law and civil law countries,to sum up the practices of States have in common,to extract the useful experience in order to provide useful reference for establishing the procuratorial prevention organs of criminal miscarriage.Part ?: On the all above basis,I will make two recommendations from an external protection and internal defense,with a view to provide assistance for the he procuratorial prevention organs of criminal miscarriage.
