In 2012,the new criminal procedure law which has added has made significant modifications and improvement to the conditions,the place of execution and the way of implementation and so on,which has added a lot of new regulations and connotation.As a non compulsory measure,the monitoring system of residence plays an important role in the criminal procedure law.From the practice of the legislation and judicial practice of the residential surveillance system,there are still a lot of places to study,improve and residential surveillance.It ranged from “bail” non coercive measures in custody to independent “arrest”custody of compulsory measures,which has the independent status of the proceedings.The newly revised "Criminal Procedure Law" embodies the spirit of respect and protection of human rights in many perspectives,one of which is the addition of the residential surveillance system.The addition of residential surveillance has aroused widespread concern in the judicial and academic area.In the judicial practice monitoring living compulsory measures still face with many problems.In applicable cases,execution and modalities for the establishment,implementation and supervision still need further discussion,in order to make correct understanding and application in judicial practice.The author will further discuss and analyse the residential surveillance system from the perspective concept,chaeacteristics,values,functims.existing problems and other compulsory measurs of comparative analysis and suggestion.Which hopes to provide new idea for legal practice.This paper aims at making residential surveillance system adapt to china?s special situations both from theary and practice and promote the development and effective opration of the system.
