A Study On The Protection Of Kazakh Folk Literature And Art Works

Kazakh folk literature and art works refers to the inability to determine the specific author,but there are sufficient circumstances can be presumed by the Kazakh group or tribal creation,and experienced generations of inheritance and development of the perfect performance of the Kazakh life characteristics and cultural charm of the people,the specific forms of literature and art,such as folk literature,folk music and dance.Kazakh is a nation with an ancient civilization has a long history,creating a rich and colorful traditional ethnic culture.Kazakhs create mysterious civilization and treasures,embodies talent and wisdom of folk literature and art works.There are many shortcomings in the legal protection of the Kazakh folk literature and art works.If the law is not provided in time,many excellent traditional national cultures may disappear forever.Based on the problems and shortcomings in the protection of Kazakh folk literature and art works,this paper discusses how to effectively protect and improve the legal system,so as to work nicely to inherit and develop the Chinese folk literature and art works,including Kazakhs.This paper is mainly composed of the following parts:The first part is an overview of the Kazakh folk literature and art works.First of all,from the concept of folk literature and art works,and distinguish some concepts from similiar definition between the scope of the basic theory to do a simple overview.And then on this basis to introduce the concept,species,characteristics,values and the need for protection of Kazakh folk literature and art works.The second part based on relevant provisions of international literature and art works,research the legislative situation of our country.First of all,the paper summarized and analyzed the protection of folk literature and art works in the relevant countries,relevant international,interregional treaties and international organizations between the relevant provisions.Secondly,at the level of national and local legislation,analyzes the protection of folk literature and art works in China from the attitude,practices and legislative trends.The third part is the present situation and the insufficiency of the protection ofKazakh folk literature and art works.And based on the reality,combining different kinds of protection in literature and art works,the author analyzes the existing problems of the protection of the different kinds of folk literature and art works.In the fourth part,the author puts forward some measures to protect the folk literature and art works in our country from the shortcomings of the protection of the folk literature and art works of Kazakhs,It mainly includes: perfecting the legislation on the protection of intellectual property rights of folk literature and art works,setting up a comprehensive common protection mechanism for private law and public law,establishing a reasonable database and benefit sharing mechanism,strengthening the rule of law publicity and education,cultivating legal professionals,strengthening international knowledge Property rights cooperation and so on.
