As we step into 21 st century,internet and information technology is developing so fast that transborder flows of personal data become more and more common.This does not only affect our private lives,but also connect to the development of social economy and national security.From the perspective of its nature,“flowability” is where personal data’s value comes from.However,as every law has its geographical boundary,the high “flowability” always makes personal data out of control from its original legal supervision system.In order to prevent our personal rights being harmed by this,international society and many sovereign states are making legislation attempts to protect our personal data.European Union(EU)is one of the earliest regional organization trying to protect personal data.Its legislation and regulation have important guiding significance to the EU countries.As the deepening of European integration,this guiding significance becomes more significant.So,the study of how EU protects personal data could not only help us to understand individual EU country’s legislation in this area,but also to provide some references to China.This article,with 5 parts,mainly discuss and analyze the content and developing process of legislation and regulation to protect transborder flows of personal data in EU.As the beginning of this article,part 1 and part 2 briefly discuss the personal data and fundamental issues in its transborder protection regime,and explain the rise of personal data protection in EU.The 3rd and 4th parts of this article are quite crucial.These two parts will give a detailed discussion about EU’s practice before and after its reform by a series of comparative analysis from principles,categories,purposes,method,to supervision and supporting measures,trying to clarify the EU reform’s critical information and more details.In the end,the 5th parts analyzes the protection principles、methods、the value balance and the supervision methods of our country’s current situation,and makes some legislation suggestions,trying to contribute to the establishment of our own regulation of transborder flows of personal data. |
