Analysis On The Implementation Of The Disciplinary System Of Dishonest Debtor

Since the reform and opening to the outside world,the market economy has developed rapidly,and the social transformation has been fast,and a lot of social contradictions have come into being.Along with the reform of the system and mechanism,the "difficulty in execution" has become a major issue in judicial reform.The system of punishing the debtor who broke the trust has helped ease the difficulty of enforcement.This article through the W city S District People's court 2016 annual civil execution case as the object of study,investigate the court in the debtor's disciplinary system implementation problems,and put forward some suggestions for improvement.The S District People's court cases based on the statistics,the text is divided into three parts,the first part of the analysis of debtor disciplinary system implementation in the S district court,are described in detail from three aspects,from the 2016 civil execution cases closed,there are dishonest debtor related crime and punishment the implementation of discipline,and limited,careful analysis of relevant circumstances of the case.The second part expounds the main problems existing in the implementation of the disciplinary system of the debtor who breaks faith,and reflects the main problems from two aspects of the systematicness and linkage mechanism of the system.The third part,from the point of view of the perfection of the disciplinary mechanism of the broken debtor,puts forward some suggestions through improving the enforcement mechanism of the court and improving the mechanism of joint credit punishment.The author selects the W city S district court case as the object of analysis is based on the W,located at the western frontier,is a typical regional ethnic autonomous areas,has its particularity,the S district court is the key demonstration local grassroots courts of the judicial reform,so the author has the typical investigation and analysis in the regional court disciplinary system the problem.On this basis,to carry out demonstration and analysis,so as to promote the summary of the implementation of the problem,the proposed implementation of the system of dishonesty debtor disciplinary recommendations to better solve the difficult problemof enforcement.
