Research On Legal Issues Of “Special Car”'s Governance In China

It is worth paying close attention to the research on “special car”'s governance.”Special car”is a new phenomenon of Internet,there are different attitudes towards its governance.Furthermore,it plays a more and more important role in urban transportation,the solution of “special car”'s governance has relation to its development.At present,the government administer the “special car” according to the current laws and regulations which is applied to taxicab operation and some temporary policy.There is not specialized laws for the government to implement,as a result,enforcement varies by different places.More disastrously,the conflict between “special car” and traditional Taxi is being aggravated.All in all,the problem of “special car” has not been solved all along.This paper aims to analysis the“special car”,including its rationality,region,effective channel of development between“special car”and traditional Taxi.The critical way to govern the “special car” is to propel the legal construction further,correctly handle the relationship between the government and the market,offering different perspectives on “special car”'s governance by reducing administrative procedures for examination and approval and promoting fair competition.Positioning the “special car” at a complement to the urban public transport,it can take advantage in market regulating mechanism.By analyzing the operating mode of “special car”and current development situation,the governance of “special car” should break through the Taxi mode,keep in line with the rule of law,promote the fair competition.On the one hand,establish standardized manipulations from central to local,guarantee that the government exercise the administrative power by law not policy;On the other hand,simplify administration,construct the Service-oriented Government,guide the industry self-discipline,restrict the public power and protect the rights of private,perfect the society with rule of law.In consequence,research on the governance of “special car” is not only about the effort how to govern a new phenomenon,but also about the thinking how to restrict the public power and protect the rights of private.
