Research On The Forensics Of Electronic Evidence In Criminal Litigation

Electronic evidence,as a product of modern social science and law,is more and more likely to bring people from the subjective reality to the objective reality.There is no doubt that the forensics of electronic evidence play an important role in the clues to criminal cases.The electronic evidence in this paper refers to the material that can be proved to be confirmed by the use of modern technology and its equipment storage,processing,transmission and output of electronic information and its appendages and the sending of living creatures.At the same time,this paper puts forward three main electronic evidence and substantive characteristics of the "medium" and"vulnerability","original claa”.Different from the traditional evidence,due to the characteristics of electronic evidence,electronic evidence often determines whether they have the legitimacy,the process of gathering evidence often affect the authenticity of the evidence,even specific forensic methods also affect the strength of the electronic evidence that force.The electronic evidence collection and preservation,extraction,transfer,analysis of evidence submitted by the whole process is defined for the forensics of electronic evidence.At the same time,it discusses the necessity of the research on the forensics of electronic evidence.At present,there is a lack of legal system in our country's electronic evidence forensics,which needs to be standardized.and specialized.Because these issues are linked together,there are none of ways can solve alone.Therefore,this paper based on the definition and characteristics of electronic evidence,focuses on electronic evidence forensics principle,electronic evidence forensics method,the fixation and preservation of electronic evidence,and from four aspects of electronic evidence exclusionary rule of revelation is discussed,and try the best to make some contribution on the research on the forensics of the Electronic Evidence.
