Research On The Legal System Of The Company's Defects

China's socialist market economic system is deepening reform.As a commercial subject,its characteristics need to meet the basic requirements of China's market economy,so the company must be one of the main transactions of the modern economic market.The author analyzes the present situation of the establishment of the remedy system of the company 's blemish,and finds that there are many problems in the relief system of the company' s blemish.The specific remedies of corporate flaws have caused many scholars to think,and remind the legislators must look at this issue again.The legal relief system for the establishment of the defective company is a complex legal and social problem.At present,there are still some shortcomings in the legislative level,so it is an important means to protect the security of the market and the stability of the market in order to perfect the market access mechanism and improve the relief system of the flawed company.In view of this,the author thinks that it is of great theoretical significance and important influence on the establishment of legal system and the improvement of legal remedy system caused by the defective establishment of the company,which is of great significance to the maintenance of market economy stability and transaction security.This paper first analyzes the basic causes of the company's flaws and other factors,followed by the establishment of the company to explore the concept of the establishment of the principles and changes in the basis of the establishment of flaws to explore the company's external manifestations.Then it contrastively studies the basic system of setting up corporate defects in some typical foreign countries,and summarizes the system of company flaw establishment in our country.The author points out the shortcomings of the system of flaw establishment in our country,and in view of these shortcomings,perfects the legal remedy system which is in conformity with the situation of our country.In this paper,the establishment of the company's flaws and related legal relief system is only to put forward some superficial views,there are still some issues to be resolved,hoping to lead to more flawed company relief and other related issues to explore in order to China's companies The perfection of relevant laws and the construction of rule of law in our country.
