Margin trading is considered as an imPortant stock transaection method and a mature stock system,which has been widely adopted by many countries and regions.In our country,since the history of the bond-market is comparatively short,and there exists risk in nature in the margin trading,our bond market has been built more than 10 years but for controlling the risk,our country always forbids margin trading.It is widely believed that margin trading has experienced from banning to solution,and the first official trading was held on March 31,2010.Although our country margin trading system is gradually perfect,but there are still some problems existing trading system hasn't been solved yet.Among them,the legal nature of margin trading decide how to guarantee,apply what architecture to better adapt to China's trade practices,etc.,since the restoration of margin trading system has been controversial,academics are still unable to form a unified opinion until today.Therefore,this article attempts to the guarantee system of margin trading for a relative system,at the same time,the nature of the guarantee system of margin trading battle for evaluation,trying to sort out more chaos margin guarantee system in our country.The work in theory,can provide the support to improve margin guarantee system in China.In practice,the clear margin exchanges involving the rights and obligations of the parties subject,guiding the securities lending and borrowing business run smoothly,is undoubtedly meaningful.This paper roughly divided into four parts:The first part combed margin guarantee system of the legal adjustment framework,mainly analyzes the margin collateral contract law,trust law adjustment framework adjustment framework and security law framework,but also to our country the current margin guarantee system.The second part is about some of the industry focus on more class structure mode comparative analysis demonstrates that the fully affirmed the class structure has a few different appropriateness,on the basis of further analysis of the problems in the practical apply.The third part of our current margin guarantee transaction model,the first combed the pattern of the moment of the trust architecture as the main body in our country,has its natural advantages in practice,after further analysis of the defectsThe fourth part is about the perfection of the guarantee system of margin trading in China,on account of the redesign,and perfect the architecture model of trust as the main body and so on proposed his own ideas...
