On Improvement Of Chinese System Of Consumer’s Right Of Withdrawal

The revised “Law on Protection of the Rights and Interests of Consumers”(herein after referred to as the new “Consumer Protection Law”)endows consumers with right of returning goods without reasons in teleshopping field,namely,the shopping by internet,television,telephone,and mail-order etc..That is the consumer’s right of withdrawal discussed in this paper.On this basis,the deficiencies of the system were analyzed and related improvement suggestions were put forward.This study is consisted of four chapters.Chapter one is an introduction,mainly including the introduction on the background and significance of this study,the definition on the designation and legal nature of withdrawal right,and the review on the researches concerning withdrawal right in China and abroad.Chapter 2 lists the practical problems of the consumer’s withdrawal right system in China since the implementation and analyzed the deficiencies of this system mainly from aspects of application scope,application rules,and reasonable restrictions.Chapter 3 discusses the consumer’s withdrawal right system of other countries,especially those of Germany,England,and America.Besides,conclusion is given to the advanced experiences of the foreign countries and the enlightenment for improving the withdrawal right system in China.Chapter 4 proposes suggestions for improving the consumer’s withdrawal right system in China mainly from aspects of application scope,application rules,and reasonable restrictions.Analysison the deficiencies of the consumer’s withdrawal right system is purposed to find targeted ways to solve these problems,and suggestions for the consumer’s withdrawal right system are to more effectively guide the application of the system in practice.In summary,both of them aim at protecting consumer’s legitimate rights and interests ultimately.
