Because the development of the pledge of accounts receivable,making its system further improve,but the deficiencies are uncovered too,particularly their application in judicial practice with the real right Act.Accounts receivable is a typical product of the commercial activities,when them as a subject of pledge system backed by commercial property,them will be more commercialize.Compared with the civil system of guarantees,them emphasis on benefits and financing.This article focuses on the characteristic of the pledge of accounts receivable,and the judicial cases in recent years.This article is divided into six parts were discussed.The first chapter is the introduction section,mostly introduce the background and significance of the research and methods.From the perspective of commercial security to explain the meaning of the pledge of accounts receivable,and summarizing the Chinese and foreign scholars have studied.In this section,completed the discussion of the basic knowledge,and pointed out the direction of research.The second chapter tried to comb intellectual dot,and focus on two issues.One describes sources of receivables,to explore the goal set and development pledge of receivables system,comparing the concept of commercial guarantee and other concept;second analysis the concept of accounts receivable,focused on the special legal nature of accounts receivable,then know the whole system.What is more,to introduce the pledge of accounts receivable legal system,highlighted China's market economy,the characteristics and requirements of financing,thus for the following analyses for the accounts receivable system in foundation.The third chapter was directed against the introduction of the real right Act,pledge of receivables occurred in the judicial practice of the system analysis of the dispute in recent years.The problems as the scope of the accounts receivable,the set of pledge if you need to notify the third person,registration for incomplete registration authority and so on.Combined with specific cases,and raised the shortcomings in the existing system of issues.The fourth chapter through the typical foreign countries pledge system to analysis and research,then compare with Chinese current system,and draw inspiration.The fifth chapter perfecting the pledge of accounts receivable system and make appropriate recommendations.Clarify the legal relationship between the rights and obligations of the parties and the relief.On this basis,promote the improvement of China's credit system and construction of the supporting system.
