Localization Of Attorney's Presence System

Attorney's right of presence is one of the contents of the right of defense,which restricts public power.It is the requirement of the human rights protection theory.However,the newly revised Criminal Procedure Law and the reform of the criminal procedure system have not put forward the concept of the right of attorney presence.Practice of foreign countries and some parts of our country has been showed the value of attorney's presence right.It's difficult for us to establish the system quickly.We need to understand the meaning of the system first.This thesis is divided into four parts.The first part clarifies the concept of attorney's presence right,describes the connotation and classification of attorney's presence right,defines the attorney's right which exist in this thesis,and discusses the theoretical basis of attorney's presence right.The second part discusses the necessity and feasibility of establishing the system.This part discusses the value of the system,analyzing how to establish the system in our country by using the experience of foreign country.The third part discusses the difficulties we will faced in establishing the system.The fourth part puts forward the idea of establishing the system in our country,which is divided into two parts.This part discusses the scope of the system,the rights and obligations of attorney and the procedure of the system.
