Research On The Liability Of Medical Damage In China

In recent years,the doctor-patient conflicts become more and more fierce,and the doctor-patient dispute is difficult to resolve,which makes the research of the liability for medical damage more meaningful.At present,the medical liability system is no longer simply the content of the legal system,but also increased the hot issue of the whole society.In view of the special nature of the medical industry,there are many differences between medical damage and general tort.Although People's Republic of China "tort liability law" to regulate the provisions related to the content of medical damage liability system,but still can not completely solve the medical dispute,medical tort litigation still did not receive a fair judgment.We intend to provide a certain reference value for the construction of good doctor-patient relationship through the study of China's medical liability system.The thesis is a research on the medical liability system in the perspective of tort liability law.Firstly,it elaborates the research background,purpose,significance and status of medical damage liability system,analyzes the legal environment of the system and the social environment,environment provides a good support for research in this system.Secondly,discusses the related theory of medical damage liability system from the connotation,characteristics and types of medical malpractice liability,and other aspects of the relationship between similar experience of special conditions,put forward the corresponding solutions for the existing Chinese medical malpractice liability system problems,and puts forward the deeper planning for perfecting our country's medical malpractice liability system.The doctor-patient relationship is one of the numerous relationships in the whole society,but the contradiction between the patient and the patient has seriously affected the harmony and stability of the whole society.We study the medical liability system can not only provide a theoretical support for resolving medical disputes,to reconcile the relationship between doctors and patients,but also provide a good legal support for the final realization of the harmony and stability of the whole society.To this end,we need not only to strengthen the theoretical study of the system,but also need to link theory with practice,so that the research results can better serve the people.
