Research On Criminal Trial Procedure Quickly In China

In recent years,the contradiction between the finiteness of judicial resource and the rapid growth of caseload has arisen gradually,the judicial organs especially the grass-roots courts are under growing judicial trials pressure,which is manifested clearly by the predicament of “ limited personnel for too many cases”.In order to enhance judicial efficiency and optimizes the use of judicial resources,the judicial reform is urgent.Among the civil procedures,the superiority of the present small-claims procedures become increasingly apparent,criminal speedy trial procedures is also necessary.Thus,on June 27 th,2014,the Ninth Meeting of the Twelfth NPC Standing Committee passed the decision regarding the authorization for conducting pilots regarding criminal speedy trial procedures in some areas,authorized the superior court and the superior procuratorate to conduct pilots regarding criminal speedy trial procedures in 18 areas all over China.The pilots have achieved good performance after being conducted for more than 2 years,yet some problems still lie in it.Researching on this procedure,theoretically proving the foundation of legitimate regarding the speedy trial procedures and solving practical judicatory problems is of great significance to promote the judicatory practice and the reformation of litigation system in China.In this dissertation,a preliminary study on criminal speedy trial procedures was made.The primary characteristics of speedy trial procedures are revealed by the comparison between speedy trial procedures and other related procedures,the necessity for establishing criminal speedy trial procedures in China is proved theoretically,an investigation on criminal speedy trial procedures of representative countries of Anglo-American law system and continental law system is conducted,and detailed introductions of the system characteristics of the countries mentioned are made.Focused on this viewpoint,this dissertation studies on the status of the criminal speedy trial procedures reformation in China,points out related problems and put forward pertinence suggestions.
