An Empirical Study Of The Marriage Registration System Affecting The Divorce Rate

Marriage is the most important social relation in each family, and the family stability is a matter of social harmony, so that the marriage registration system just like the cell is crucial for every society. Divorce registration system is an important constituent part of the marriage law, and its historical evolution and development is closely related to people's marriage life. Since the founding of new China, our country has experienced the major historical transition and change time and time again. The constant economic development, social progress, cultural prosperity, and the continual improvement of people's living standard also put forward a higher request to the marriage. Marriage freedom and the equality between men and women are an important principle of marriage law which also penetrate the whole marriage institution in our country. Our people boldly pursue the marriage freedom and happiness in life after casting off the yoke of the feudal ideas, which embodies the humanity and science of our country's marriage law. However, in recent years, our country divorce rate rises year by year, and all kinds of cases of family breakdown emerge endlessly. The sharp increase of the divorce rate should arouse our vigilance and thinking.This paper starts in studying the change of marriage registration system in our country, and makes a deep interpretation mainly focusing on the historical change of divorce registration's relative law system. Besides, it makes a systematic analysis of the social phenomena about the constantly rising divorce rate. It is found after the research that in the process of assuring the “degree” of divorce freedom in our country, not only the basic tenet of marriage freedom should be carried out, but also the additional damage of excessive freedom to family and society should be avoided.This paper starts from the historical change of divorce system in our country, and combines A district's marriage archives information and the real changing trend of this district's marriage structure by applying the case and quantitative analysis to analyze them one by one. It points out the influence of the current divorce system on the rising divorce rate in our country, the excessive divorce freedom and insufficient restrictions, the lack of the necessary system' s protection to the weak party concerned and minors protection, and the technical vulnerabilities existing in the lack of necessary systems themselves. Finally, the personal opinions on how to perfect the marriage registration system will be presented.The writing framework of this paper focuses on the change of marriage registration system since the founding of our country and the analysis of the structural change of A district people's marriage registration. It teases out the influence of the current marriage registration system on the divorce rate from the elements of marriage registration law, morality and ethics, the main administrative department, and technique which affect the divorce rate. Combine with the actual cases to analyze and find the existing problems, explore ways to improve the marriage registration system, such as adding the penalties of marriage registration fraud, properly restricting the excessive divorce freedom on the procedure, setting up the special marriage psychological counseling mediation organization, putting forward the constructive suggestions to strengthen the construction of network platform. To find the key points which are the most beneficial to protect the vulnerable groups, to maintain family stability at the maximum limit and the most conducive to maintain the social balance.
