The Study Of Interactive Mechanism Between Litigation Master “xiejia” And Local Government In Qing Dynasty

The initial and basic meaning of “Xiejia” is inn. It could appear in historical materials. The article is focus on the litigation master “Xiejia” in Qing Dynasty, and limits the research perspective in the states and counties of the litigation area. We can find the role orientation of “Xiejia”in the litigation area of Qing Dynasty by analyzing the interactive relationships between litigation master “Xie-Jia” and local government. There are three relationships between litigation master “Xiejia” and local government in litigation area: Convergence of Interests, Conflict of Interests and Compromise of Interests. We can have distinctly cognition on “Xiejia ” in Ming and Qing Dynasties.Part two: The precondition on convergence and conflict relationships in pursuing interests between litigation master “Xiejia” and local government, that is to say “the establishment of Baoxie system, a series of Xiejia contracts in Ming and Qing Dynasties and the function about subpoenaing the parties in Xiejia”.
