Study On The Local Government Responsibility In The Process Of Rural Women's Land Rights And Interests

Theory circles have reached a consensus about the importance of women's land rights protection:Land rights is the most important property rights and interests of rural women;Protection of rural women's land rights and interests is the protection of women's rights to survival and development.However,at present,there are a lot of problem with rural women's land rights:On the one hand,women's land rights and interests is easily to lose than men,women's right and interests such as land,homestead,land income distribution are lossed with the change of marriage.On the other hand,with the government expropriation behavior,rural women's social security such as compensation and job placement are not fulfilled the designated position.The deletion of rural women's land rights and interests is not only restricts the development of social economy,but also affects social harmony and stability.As a national authority performer,local government should due responsibility to protect citizens legitimate rights and interests,therefore,from the responsibility of the local government perspective to study the rural women's land rights and interests protection becomes an urgent appeal of the rural social's harmony and stability.This paper based on the strengthening of local government responsibilities to protect rural women's land rights,with the local government responsibility as the starting point,positioning local government responsibility in the protection process of rural women's land rights based on defining the basic concept and theoretical study,and analysis the local government responsibility in theory,they are legal policy guarantee responsibility,democratic environment responsibility,the land market supervision,the supply of social security responsibility,channel to relief responsibility.At the same time,through the investigation of local government responsibility in Linfen,Shanxi province,the author analysis the responsibility of the local government.The survey showed,the effect of local government protect the women's land rights is not obvious in Linfen,women's satisfaction is low;local government responsibility to protect the women's land rights is defected on the policy formulation and implementation level.The author analyzes the general reason of the defect with local government responsibility,find the oversight to women's land rights of law,the lack of local government responsibility consciousness and mechanism,the defect of financial responsibility are the implement effectiveness factor influence the local government responsibility.Finally,The author put forward to perfect the measure of local government responsibility on the basis of reference domestic and foreign governments measures to protect women's land rights,these measures mainly include:perfect the relevant laws and regulations,clear local government to protect the land rights of women;improving local government administrative personnel consciousness of responsibility to safeguard the women's land rights;build the information platform of rural women and the local government response mechanism;strengthen the rural women's social security fund investment,management and supervision;correctly handle the relationship between local government and collective village and guide the villager autonomy;give full play to the role of women's federation,decompose the function of local government.
