The Third Plenary Session of the 18 th CPC Central Committee had decided to improve the ability of discussing and supervising major government policy in the People's Congress system. The People's Congress system is the fundamental political mechanism of our country, China. It is institutional guarantee of the security and prosperity of our country. According to the constitution of China and organization laws of China, all levels of the People's Congress and its standing committees have the power of discussing and deciding vital events of Politics, economic, education, science, culture, health care, environment and resource protection, civil policy and races within its administrative zone, which can be concluded as the decision right of major issues. The legal usages of the decision right of major issues of the People's Congress as well as its standing committees have many important meanings. Firstly, it is basis form of putting the principle of people as the masters of their own country into practice. Secondly, it is the major method of Chinese people to involve democratic politics and thus achieve the goal of the principle of people as the masters of their own country. Thirdly, it is an important way for civilians to express their requirement in the era of society transformingHowever, on the whole, the present situation of the practical usage of the decision right of major issues is still not fully functional both in theory study as well as power in action. For example, the theory circle had not yet reaches a conclusion about the decision right of major issues of its theory basis, definition standard and practical mechanism. The current situation of implementation of the decision right of major issues is also imperfect. The law and other forms of standards have many defects, including the unclear standard of vital events, the unsound setting of implying procedure, lacking connection between the CPC committee, the government and the people congress, weak awareness of the presenter of the congress of applying their duty, unclear practical ability of the people congress, etc. All this problems make the decision right of major issues into a mere formality and lack of true effects, especially for the events that do not be listed in law yet still effect the civil society and economic greatly and thus such power can merely match people's hope.To change this situation, the author write this article, which major points are base on the traits of the People's Congress' s perform-duty behavior that the bills should be submitted by the member of the People's Congress, judged and decided by the congress and executed by the government. In order to discuss how to defining the standard of so-called major issues by the logic of political science, this article starts from the analysis of the theory and legislative status of the decision right of major issues as well as the different decision right of the congress abroad. The theory is base on the true situation of the People's Congress' s perform-duty behavior of the decision right of major issues in certain areas of our country and had taken the experiences of Chongqing Nan' an district and Guangzhou city take find out the mechanism of how the People's Congress apply its duty by the decision right of major issues and how should it be developed.
