According to statistics, amid the trend of China national medical treatment, there are millions of people willing to have plastic surgery for beauty, in 2009, there was up to more than 200 thousand professionals and other personnel working in China medical beauty industry, the number of medical beauty hospitals, clinics and departments was over 50 thousand, and the annual operating income exceeds RMB 15 billion. However, the most of the so huge industry operates underground difficult for the public to see, and the regulation of medical beauty industry also exists in name only. Up to now, China whole beauty industry has inconsistent management concept and value orientation, there are many chaotic phenomena, clownish and beauty is very closely associated with each other, and the frequent cases of death from plastic surgery tell us that: the industry under the banner of �creating beauty�brings destructive danger to consumers. As the inspection, examination and legislation of medical beauty industry are unimproved, the market mode of no trouble if no accident and self digestion after accident, some private medical beauty salons even have their own invisible aftermath�rules�for medical beauty accidents, special for dealing with medical beauty disputes.Although the Ministry of Public Health strictly prohibits the beauty salon from being engaged in medical cosmetic surgery in Regulations on Medical Beauty Services, the excessive profit not only lets the operators scramble for, but also enticing some medical employees to give up the basic professional ethics and standard. Many doctors are illegal,without qualification certificate of national plastic surgeon, some students of medical college can do operation on the face of patients with scalpel just after graduation, and some plastic surgeons even do plastic surgery for criminals for evasion of legal sanction.For the above chaotic phenomena, who shall bear the responsibility? What responsibility shall be borne?According to the special field of medical beauty, this paper makes comparison andanalysis on the current situation of foreign relevant legal regulations on the basis of discussion on legal relation between both sides of medical beauty through research on the main features of medical beauty, points out the problem of application of crime laws in China medical beauty field at present through using foreign experience for reference,focuses on analysis of the role of Criminal Law in regulations on crime of medical beauty field, and gives suggestions on improving relevant laws and regulations, hoping to provide modest strength for promoting sound and orderly development of medical beauty industry.
