Electronic Data Collection Research

In 2015, the latest judicial interpretation has been clear about the type of electronic data, this will help us more comprehensive understanding of the electronic data of the new evidence, as a kind of new evidence, the electronic data appeared in our country and even around the world also but decades of history. Electronic data collection and research in China is still in its primary stage, although the judicial interpretation of the electronic data types made the general rules, however the electronic data collection subject, collection rules are not detailed, perfect the electronic data collection measures is imminent.In this paper, starting from the concept of electronic data, analyzed the characteristics of the electronic data, common electronic data made the civil lawsuit is introduced in detail, and compared the main countries and regions outside the electronic data collection of relevant information, analyzes the electronic data collection problems and reasons, and puts forward measures to improve the electronic data collection.This article mainly from four aspects elaborated the electronic data collection..The first part first introduced the concept and characteristics of electronic data, and points out that the electronic data dependence of science and technology, besides the key electronic data collection and the difference between traditional evidence collection,at the same time for the people is one of the more common in the email, text messages,network chat records that the electronic data of the three common relatively detailed analysis, points out that the three kinds of electronic data collection may face the problem.In the second part, by using the method of comparative study, this paper introduces the Anglo-American law system of Britain and the United States, Germany and Japan,two countries (regions) of continental law system and China’s Taiwan, China’s Hong Kong electronic data collection regulations, through the comparative analysis, puts forward the enlightenmenton the electronic data collection in our country.The third part points out that the current situation, problems and the cause of the electronic data collection in China.The fourth part puts forward some perfecting measures of electronic data collection,the main rule to follow when collecting electronic data was put forward and rules,expounds the main body of collection, collection methods available now and other procedural requirements.
