The follow the world changes is gradually showing a modern,civilized,mitigation of humanitarian,fine punishment as a punishment of criminal penalty,compared with the free penalty of penalty,more easily in solving the social contradiction,constructing the harmonious society has better effect,so the fine penalty in the penalty the role of self-evident.Because of China’s traditional legal concept ingrained,penalty in China is compared with that of western countries is extremely quiet,until the 1997 introduction of the new criminal law,penalty status was changed,but there are still many problems in the judicial practice,so it cannot play the real utility,cannot achieve the desired purpose of legislation therefore actively explore the fine penalty is necessary to the fine penalty in the legislative,judicial and other aspects of the defects and put forward reasonable suggestions for improvement,is expected to become China’s fine development power.In this paper,the fine punishment from a macroscopic to microcosmic,the text is divided into six chapters,each chapter analysis fine punishment from different angles.First chapter is about the concept of fine punishment,type,etc,based on the macro view in this paper,the basic theory of fine punishment;The second chapter discuss different era of fine punishment from historical Angle,summarize the advantages of the fine punishment in every age;The third chapter is on the pros and cons of fine punishment,do take its essence to its dregs;Fourth and fifth chapter from the legislative and judicial perspective to explore the present situation the existence of the fine punishment;The sixth chapter is to analyze the defects of modern fine punishment,fusion the content of chapter two,three,four,five,on the whole thinking about how to perfect our country fine punishment and puts forward specific measures:expanding the scope of the fine punishment,increasing the number of fine punishment of probation system,permitted system.Article six Angle from which to explore the fine punishment,perfect strategy thinking,hope to be able to work out effective ways to improve our country fine punishment,contributing to the rule of law construction of our country.
