On The Perfection Of Auxiliary Expert System In The Civil Litigation

Technology develops fast ,amounts of professional issues affect the civil litigation.Judges and parties who lack of professional knowledge can't handle these problems,and make a good decision. So judges and parties will need the help of expert. We have also found the Auxiliary expert system after drawing on experiences of expert systems abroad, basing on the present legal institutions and summarizing the excellent experience.The concept of" Auxiliary expert"can't be found in articles of law,neither the Civil procedure nor the judicial explanation. The theorists and practical departments call them Auxiliary expert,who can solve the professional issue and with a professional background.Auxiliary expert is different to other concepts,such as witness,the Appraiser and the lawyer. Auxiliary expert has its own character. If we want to improve our Appraiser system,the step we must take is to build a perfect Auxiliary expert system,Auxiliary expert system can not only make up for judge 's shortage of professional knowledge,but also protect the right of both parties.But look at our legal institution now,the legislative provisions of the system is simple and lack of operability ,So it is necessary for us to build the system perfectly.This thesis was made of four parts.I made a basic introduction of the system at first,made a comparison between Auxiliary expert and other concepts.Secondly, introduced several expert systems abroad and summarized the inspiration which other systems showed us, At the third part,this thesis showed us the present legal rules of this system and analyzed the problems occurred during the practice.The last but not least,this thesis tried to offer some suggestions basing on these problems that talked before,such as some operations and other things. So that we could build a better legal system,and it could satisfy the needs of society and the judicial practice.
