Research On Micro-blog Tort Liability

Along with the rapid development of modern science and technology,especially the application of the Internet popularization,the Internet has begun to replace traditional channels of People's Daily entertainment and communication,are indispensable tools of modern work and life.Weibo developed based on the Internet as a platform of communication tool,has the characteristics of high-speeding and liberalization,weibo is anonymous,however,at the same time also can form the polarization of social group,to an adverse effect on modern society sense of responsibility and the moral quality,the most intuitionistic performance is increasingly network infringement event.Events,so,how to effectively deal with all kinds of network infringement of intellectual property rights to safeguard the legitimate,also become the problem that the current legal system need to be addressed.In this paper,the current legal system in China made deep analysis and discussion,found that there were shortcomings,then targeted advice are put forward.Under the new situation,draw the main responsibility for weibo infringement type and should be advancing with The Times.In the clear weibo infringement has particularity,based on the original weibo,weibo postings,forwarding microblogging and microblogging service provider's point of view,for weibo tort has made an in-depth analysis,and rules of foreign infringement of weibo principle has carried on the summary,through comparing with our country,looking for experience is worthy of reference for our country.
