In any country,the police or the police authorities is essential for state organs.Police use of firearms in order to better fulfill its statutory duties.Make the police use of firearms regulations,in order to relationship 'between state power and citizen rights balance.In our country,the police used guns provisions are scattered in different levels of many of the laws and regulations,emptiness,the relevant provisions of the responsibility and power relief program defects,which easily lead to people's police due to the use of weapons or improper abuse and the citizen's basic rights and legal order brought serious harm,but also damage the image of the police's authority.In this paper,we will discuss the present situation and the lack of the use of firearms in our country?Through the study of the current law in China and the relevant legal system of foreign advanced countries,this paper puts forward some suggestions for the improvement of the legal system of the use of guns by the police in our country.
