The Research Of Fabricating And Spreading False Information Crime

In the media age,information has become the people’s important content of accessing to social resources,the formand carrier of information technology tends to diversification,however,the false information is also filled with every corner of life,not only caused great harm to individuals and public order,but also cause extremely bad influence on government agencies and national image.《 Criminal law amendment(nine)》adds “fabricating and spreading false information crime”.It’s a further establishment of the penalty system,makes up for the absence of false information crime in the traditional criminal law,and stricts criminal law.It is conducive to the regulation of fabricating and spreading false information,but in judicial practice,there are many problems,such as the existence of “false information”is narrow,how to define the relationship of fabricating and spreading,the distinguish problems between this crime and others.Therefore,it is not a perfect legislative amendment,this paper will combine the 《 Criminal law amendment(nine)》refer to foreign legal experience,put forwards the conception of reestablishing the fabricating and spreading false information crime,in order to make better use of the judicial practice,provide a useful thinkingfor justice qualitative accurate.
