Research On Pledge Of International Trademark

The international trademark pledge is a pledge of a trademark that is also registered in a multi-country. Trademark rights are traditionally considered to be highly territorial, and the trademark owner can not restrict the use of the mark abroad, and there is no trademark on a global scale. But now, the economic and political ties between countries become more and more close, the theoretical research on the trademark is developing continuously, the existence of the international trademark is the transfer of the right, the pledge is being recognized and studied by more and more scholars. Unfortunately, up to now, there is no international treaty to clearly define the international trademark pledge.In reality, there is a particularly urgent need companies to pledge international trademark pledges, especially those registered in multiple countries. The United States and other Western countries have been in practice to explore a more mature international trademark pledge of the way and path. China's practice of international trademark pledge has just begun, and mainly imitate and learn from Anglo-American approach.In recent years,China's enterprises to invest in the sea show explosive development,in order to solve the problem of financial constraints, more and more enterprises choose to pledge their intangible assets financing. However, China has not yet on the international trademark pledge for specific legislative provisions. Based on the basic theory of trademark and pledge, this paper expounds the legal and realistic basis of the existence of international trademark, explains the rationality of the existence of international trademark pledge, and defines the legal connotation of international trademark pledge,and expounds the practice of international trademark pledge Path, the legal conflict of international trademark pledge, legal adaptation and dispute resolution were discussed.At the same time, based on the status quo of international trademark pledge in China,this article also made a number of suggestions on the construction of China's international trademark pledge system.
