Unilateral promise is one of the reasons for the occurrence of debt in civil law.The promised contracts and unpaid promises under the influence of the Anglo-American legal system and the promulgation of the promulgation principles,as well as the provisions of the German Civil Code and the Italian Civil Code and the French Civil Code,both recognize unilateral promises.In our country,unilateral promises is lacking of regulations,the views of scholars of them are many and not uniform,and different cases which are about them often get different judgments in judicial practice.Therefore,this article will be unilateral promise system as the object of study,the purpose is to sort out the relevant theoretical controversy,improve our debt system,and improve the judicial situation.This article is divided into four parts.The first part of this paper is about the concept of unilateral promise.It includes the connotation and denotation of unilateral promises.The second part of this paper is about the normative analysis of unilateral promises.It contains the specific provisions of the Anglo-American law system are related to the single-promise contract and gratuitous promises,and civil law of the German Civil Code and the Italian Civil Code and the provisions of the law of our country unilaterally promised.The third part focuses on the empirical analysis of unilateral promises.Specifically,it is unclear about the nature of the law of unilateral promises,and the scope of compensation for losses is not perfect.The fourth part mainly introduces them which construct a relatively perfect unilateral promise system.They add specific terms to this chapter of the "causes of debt" in the law of debt,which are the specific types of legal status,definition,unilateral promises,rules of establishment,compensation systems,concurrent liability and so on.
