As Confucianism being turned into legislation, the Household Separation Order, started from Qin Dynasty, gradually replaced the ban on adults from possessing one's own property when their parents are alive. It was firstly incorporated into Tang Code in Tang Dynasty and since then the ban had been being removed from law by governments of coming dynasties.During Tang and Song dynasty, with the family value of living together and sharing property broke down and people's perspective on family property changed, laws on removing the ban also varied. This indicates the gaps between the ideas in laws and their implementation.Under the backdrop of separating households and the influence of carrying forward administration, the governments usually tempered justice with mercy when removing the ban.
