The Study On Constitutional Orientation Of The “Joint Official Documents” Issued By Party And Government

The “ Joint Official Documents” issued by party and government has been regarded as a unique phenomenon in China,which existing from the beginning of the founding to the present.Although Related studies focused on political science,because of the Special Constitution of practical utility and properties,the “ Joint Official Documents " issued by Chinese party and government not only influences itself,but also makes up the China's socialist legal system,which led by the Constitution.So it is necessary to study on the “Joint Official Documents" in an academic perspective,which means set up a clear constitutional orientation.If we take seriously to China's Constitution,which can be found that three elements of the Constitution which including constitutional origin;constitutional form;“constitutional technology”.However,according to the three “elements” of the constitutional orientation is based on the appearance of simple positioning,this kind of uniformity is often intuitive and general.In practice,party and government's joint documents could include several single positioning elements,resulting in its constitutional orientation often presents a rather complex compound.By combining the single constitutional orientation in a regular way,the party and government's“Joint Official Documents” under the compound orientation,which contains“constitutional origin-constitutional form”,“constitutional form-constitutional technology”,“constitutional origin-constitutional technology” three double orientations and a triple orientation “constitutional origin-constitution technology-constitutional technology” as well.It is necessary to carry out the constitutional orientation of the unity of the most intuitive characterization of the party and government,and to study the nature characteristics of the text itself in depth.Not only to study a real “orientation”,but also to explore how to form one kind of effective“restoration”.
