Research On Legal Issues Of Customs Clearance Tntegration On The Background Of Trade Facilitation

With the rapid development of economic globalization,foreign trade is also thriving.Countries and regions are actively exploring the way to simplify and coordinate the systems and procedures of international trade and commerce in order to reduce transaction costs and increase benefits.Thus the trade facilitation has become a common concerned topic around the globe.China officially accepted the Trade Facilitation Agreement(TFA)on September 4th,2015.According to our external commitment,China should implement most of the measures in the Agreement by the time it goes into effect.In order to comply with the Agreement,customs have recently carried out a variety of trade facilitations,paperless clearance and E-port for example.At the end of 2014,customs practiced regional reforms on the integration of customs clearance;and by June of 2016,the integration of customs clearance on national level had taken its form in Shanghai as an experimental unit which set up a convenient and high-efficiency clearance environment.The integration of customs clearance,which is a result of the combination of the Agreement and port modernization reform in our nation,has made great achievements.However,at the initial operating stage of integration mode still sees lots of practical problems.For example,it cannot fully meet the requirements of trade facilitation;laws and regulations in terms of clearance are in chaos;the subjects of law enforcement are diversified;and government-business relation lacks communication and cooperation.Under such kinds of circumstances the research introduces the concepts of Trade Facilitation,Integration of Customs Clearance,and the relationship between the two.And it analyzes foreign customs clearance systems under trade facilitation and learns experience of developed countries and regions.Finally it explores present legal issues of customs clearance integration and proposes suggestions to consummate the laws.The dissertation studies China's integration of customs clearance under trade facilitation through below five chapters.Chapter One states the purpose,significance,research trends at home and abroad,and research method.Chapter Two gives the concepts of Trade Facilitation and Integration of Customs Clearance and the relationship between the two terms.Chapter Three introduces the systems of customs clearance under trade facilitation in America,Japan,Singapore and Netherlands,and gives inspirations.Chapter Four talks about present legal issues on China's customs clearance integration under trade facilitation.Chapter Five proposes suggestions to build up trade-facilitation-centered legal structure,advances executive constructions of customs and consummate customs cooperation partnership under trade facilitation.
