Study On Legal Risk Prevention Mechanism Of Asset Securitization Of Financial Leasing

Both financial leasing and asset securitization are new financial instruments,and the combination will play an important role in the development of financial industry and real industry.However,the combination can also increases all subjects' risk because of the original risk of financial instruments.The mortgage crisis in 2008 reinforced the public's view of the importance of risk control systems.From a risk-control perspective,the essay undertakes a study of legal risk prevention mechanism of asset securitization of financial leasing based on fundamental principles of assets securitization and combining with the features of financial leasing.This essay can be divided into five parts besides foreword.The first part is the transaction risk of assets securitization of financial leasing.Combining with the characteristic of financial leasing,this part provides transaction risk from three transaction entities based on analysing the structure of transaction.On this basis,the upcoming three parts account for successful experiences at home and abroad,and explore on how to complement the legal risk prevention mechanism of asset securitization of financial leasing by analyzing the existent problems in our country.The last part is the summary and prospect of the theme.
