Research On The Responsibility System Of Handling Cases In China

The responsibility system of the case is a very important position in the system of procuratorial system and the operating mechanism of procuratorial power,and it is an important guarantee of strict justice.Perfect procuratorial organ case responsibility system is the deployment of 18 third,fourth plenary session of the important tasks,and establish a scientific and efficient core content of the operation mechanism of prosecutorial power,in the foundational status in the judicial reform.Since 2013,the procuratorial organs in perfect working responsibility system to make a lot of helpful exploration on system construction,effectively promote the exercise of procuratorial authority independently according to law,improve the judicial credibility.Case responsibility system,however,with the deepening of reform and derivative problems,with procuratorial organs working responsibility system problems inherent in our country has formed the superposition,the resistance of the present case responsibility system restore.Therefore,in this paper,based on the reform of the judicial system,combined with the "opinions" spirit and the reform of the overall situation,focusing on the present procuratorial organs working responsibility system is analyzed,the problems in the process of reform and put forward countermeasures and Suggestions to improve and promote the responsibility system reform to carry out the ground handling the case.This paper is divided into four parts: the first part by procuratorial organs working responsibility,clarify the procuratorial organs of the concept of accountability,cases,and expounds the motivation and goal of the reform of the responsibility system for handling the case;The second part mainly introduces the general induction and practice of the reform and construction of the responsibility system of the pilot province's procuratorial organs.The third part from prosecutors classification management,internal institutions reform,to carry out the prosecutors case responsibility system and build a supervision system four aspects,the current problems existing in the reform of the status quo of lack of refining and analysis;Fourth part in view of the problems is put forward to strengthen top-level design perfect case responsibility system,promote internal institutions "the super-ministries" reform,establish scientific clarity procuratorial mechanism,perfecting the monitoring management and supervision mechanism path design and improve the countermeasures of four aspects.
