Suggestions On Perfecting The System Of The Program Of Legislation

The legislative planning system refers to the legislative body in the preparatory phase of legislation,according to the actual needs of the society,on the basis of scientific forecasts,according to certain principles and procedures and arrangements for the future legislative work plan and to ensure the smooth implementation of the legislative plan of a procedural system.Since the establishment of the Legislative Council of the Eighth NPC Standing Committee at the beginning of the plan,after a period of five,just as a practice of the NPC Standing Committee,did not rise to the national law.Until the twelfth session of the National People's Congress of the people's Republic of China in March 15,2015 adopted the "decision on Amending the legislative law of People's Republic of China" on the basis of the decision of the third session of the National People's Congress,the legislative planning system was formally established.Although the legislative planning system in our country since the birth of the actual effect is not satisfactory,which led to some scholars on the necessity of its existence questioned.It is true that things will inevitably arise in the course of development of some problems,but can not be amended before the veto.In my opinion,since the reform and opening to the outside world,the legislation of our country has been in urgent need of the law of the development of the society,and the historical condition of the system has not changed fundamentally.From the point of view of the construction of the legal system,legislative planning is a necessary means of systematization and scientization of law?The legislative plan is mainly to start the legislation project,put forward the legislative summary review of the screening project,legislation,the drafting of legislation plan draft,review,approval,announced legislative plan,implementation of legislative planning process.Through the investigation of the implementation of the legislative plan,found that the actual effect of legislation planning system in China is not ideal,whether the declaration process of legislation in the legislative plan of the project or the legislative process of planning,there are in the process of the problems of implementing and planning legislation.Through the detailed analysis of the reasons behind these problems,the author deeply analyzes the realistic dilemma of the legislative planning system in china.In order to fully reflect the function of the legislative planning,the author briefly discusses the basic situation of the legislative planning system at home and abroad.Finally,some suggestions are put forward in this paper.First,dilute the impact of legislative plan of the democratic system of the proposal;second,perfect the legislation project solicitation system;third,consider the plan to enter the legislative procedure regulation on plan;fourth,strengthen the legislative plan program;fifth,strengthen the implementation of security legislation plan.
