Research On The Legal Issuesof Food Safety Regulation In Online Shopping

Food safety is related to people's lives and healthclosely,and it has always been people's attention.In the era of network economy,network food is the product of a combination of traditional food transactions and e-commerce,because of its variety,convenient,cheap and many other advantages,network food has been sought after by people.However,although there are many advantages of network food,we can not ignore the series of problems it brought about.Compared with the traditional food transaction,the legal issues of food safety regulation are more intractable under the virtual network environment,such as the imperfection of relevant legislations,the difficulty of guaranteeing the quality of foodand protecting the rights of consumers.Faced with this situation,it is necessary to carry out systematic research on the legal issues of food safety regulation in online shopping.First,this paper introduces the concept,characteristics and current situation of network food as a whole,and then points out the existing problems in ournetwork food safety regulation,and lists some experiences and practices of extraterritorial countries,and puts forward some suggestions.The main text starts a detailed introduction from four parts.The first part: This part introduces the meaning and characteristics of network food,the definition of network food safety regulation,including the meaning and elements of it;secondly,this part introduces the specialty of network food safety regulation;finally,this part puts forward the necessity to strengthen the network food safety regulation from these fundamental introduction.The second part: This part mainly introduces the current situation of network food safety regulation in our country,and highlights the status of it from legislation and law enforcement.On this basis,points out that our network food safety regulation lack of effective laws and regulations,the existing laws are difficult to protect the quality of network food and the rights of network food consumers.The third part: This part mainly introduces the advanced experiences of the extraterritorial developed countries and its enlightenment to our country in the field of network food safety regulation.It has the following experiences: The United States has complete legal regulations and sound regulatory system;European Union from "farmland to table" of the regulatory legal system;South Korea sets up central and local double-level regulatory agencies.The above successful experiences have a great significance to perfect our network food safety regulatory legislation sandimprove the establishment of regulatory agencies and the formation of regulatory systems.The fourth part: on the basis of the analysis of the above problems and the introduction of extraterritorial experiences,this part puts forward the following suggestions: perfect the laws and regulations of network food safety regulation,regulate the access conditions of network food operators and the behaviors of network food express delivery,establish the effective mechanisms to solve the disputes of network food transactions and thecredit legal system of network food operators.
