The rapid development of social information today,the legal protection of personal information has become increasingly important.Personal information has become an indispensable social resources,its attached to the value of people beyond the imagination,the pros and cons,personal information security also will lead to a variety of problems.Due to improper personal information collection,transmission,buy and sell,illegal use and a series of disharmony factors,making people's personal safety and property safety risk index soaring.According to the Chinese clerical referee network inquiries,the past two years,China's court hearing of telecommunications fraud cases actually reached more than a thousand cases,the subject of telecommunications fraud surrendered,from a few thousand dollars rose to millions of dollars or even tens of millions of dollars or even Billion yuan.Every year the telecommunications fraud to the people suffered up to 10 billion loss.And all walks of life have encountered telecommunications fraud,up to the urban white-collar workers,senior intellectuals,down to the remote mountain farmers.According to statistics,the world has more than 50 countries have developed a special personal information protection law.China's relatively backward,there is no specific personal information protection law,so I believe that in order to promote China's economic development,promote regional and regional,between countries and better trade between the moment to enhance the protection of personal information The intensity of the development of specialized personal information protection law is necessary,but also no doubt.This paper is divided into four chapters.Chapter 2 concretely describes the legal basis of personal information,including its concept,characteristics,value,analysis of its personality rights and property rights attributes;the second chapter through three typical cases to reflect the causes of telecommunications fraud: low cost of crime;Light,high rate of return;criminal techniques more subtle,difficult to break;victims of human weakness.And mainly due to illegal trading,the three major telecom operators,airlines,real estate and various training institutions and so on and lead to personal information disclosure;Chapter III to introduce the four countries outside the four personal information legislation.Mainly from Germany,the United States,Europe and Japan to sum up the personal information protection,the fourth chapter is from the legislative,judicial,other three aspects of the protection of personal information rights and interests proposed: First,the development of a special personal information protection law;Second,the personal information infringement of the legal liability;Third,improve the industry self-discipline mechanism,the implementation of mobile phone real name mechanism to strengthen the deceived deceived propaganda and mobile phone users to protect their own interests.Because of the special information of mobile phone users,this paper puts forward a series of protection opinions in order to reduce the occurrence of telecom fraud caused by personal information disclosure,so as to promote the healthy and sustainable development of personal information in China.
