Research On The Perfection Of The Administrative Regulation Of Electronic Commerce

With the in-depth implementation of the "Internet +", strategy and the widespread application of network information technology, e-commerce has gradually become the representative of the new economy and its development momentum is flourishing. This new business model raises many questions as it changes the current economic model,creates future economic development,and even affects social structure at the same time.As the e-commerce economy with the characteristics of market economy, it inevitably has the disadvantages of market economy, such as the natural monopoly, externalities and information asymmetry in the process of market regulation. And because of the virtuality, openness and cross-regional of the Internet, the performance of market failure is more diverse and complex, so it needs more necessary administrative regulation.Although the Standing Committee of the National People's Congress has launched the legislative work of e-commerce and the regulatory authorities have also taken some regulatory measures to constantly improve e-commerce administrative regulations, the regulations are still inadequate due to the incomplete basis, unclear responsibility of main body, unsound collaboration system and lagging way of current e-commerce administrative regulation in our country. Mainly from the angle of administrative law,this article takes the issue as the starting point,demonstrates the necessity of introducing the administrative regulation of e-commerce,and explores the present situation and problems of administrative regulation of e-commerce in China. So it is different from the current researches which carry out the electronic commerce legal research from the contract law, economic law, and other areas of the department law. At the same time, the paper draws lessons from the experience and enlightenment of extraterritorial e-commerce administrative regulation. Finally, according to the reality of China's e-commerce economic development, it provides reasonable proposals for the administrative regulation of e-commerce in order to safeguard the legitimate rights of consumers , maintain fair competition and provide legal guarantee for the healthy development of e-commerce.
