Charity is the common cause of all mankind.And the Internet links people from different parts of the world together.Internet fundraising is a new way of fundraising.On the one hand,it provides people with fast,convenient fundraising,donation channels.On the other hand,it also exacerbates the emergence of social contradictions.At the same time,online fundraising has also led to an increase in the number of cases about cyber-fraud.At present,the development of online fundraising has many difficulties: most of the fundraising platform is simple to set up,and lacking of legal supervision;network seeking behavior lacks legislative norms;the mechanism of punishing network fraud is not perfect.These problems are not conducive to the healthy development of China's charity.With the continuous development of Internet technology,participate in the network will raise the fundraiser.In the future,the potential and space of online fundraising are immeasurable.Therefore,the focus of this paper is the legal regulation of online fundraising.This article is divided into three parts: introduction,text and conclusion.There is four chapters in the text:The first chapter is an overview of online fundraising.First of all,different areas of researches definite the concept of network fundraising.And there is on the network fundraising with the four characteristics of a detailed statement.Then,the two basic models of online fundraising are discussed: online charity fundraising and online personal help.Next,it researches on the development status of common network public welfare at home and abroad.Finally,it summarizes the problems existing in the current network fundraising in China.The second chapter is the legal analysis and legal regulation of network fundraising.This chapter discusses the online fundraising from the two aspects of legal analysis and legal regulation.In the legal analysis,it analyzes the legal nature and legal relationship of network fundraising from the perspective of public trust and gift contract.In terms of legal regulation,it sums up the necessity and basic principles of legal regulation on network fundraising from the government,the external influence of society,as well as the fundraising body,the internal role of fundraising platform.The third chapter is the lack of legal regulation of network fundraising.It analyzes the three aspects of the network fundraising platform,the network personal help and the network crime punishment mechanism.Legislative and regulatory deficiencies lead to the problems of network fundraising platform and network help.The fourth chapter is the conception of perfecting the legal regulation of network fundraising in our country.The content of this chapter is not only the focus of writing,but also the embodiment of the value in this article.This chapter mainly aims at the concrete measures to perfect the legal regulation of network fundraising.Perfecting the legal regulation of network donation in our country should be carried out from two aspects of legislation and supervision.On the one hand,it should improve the legal system of network donations.Especially in the absence and contradiction of the charity law,it should carry out the corresponding legislation,repair law.On the other hand,it is necessary to establish a comprehensive management and supervision mechanism.It forms a full range of regulatory power from the platform,government and social point of view.
