During the past two decades,there are many scholars doing there research on the civil and commercial custom investigations which occurred in the late Qing Dynasty and the Republic of China.Nevertheless,many historical facts,such as the starting time,organizations and so on,were still been misunderstood.According to the historical experience,the civil and commercial custom investigations have little effects on the compilation of the code.In the late Qing dynasty,as the legislative principle is to be effective not only in China but abroad,the materials obtained by the investigation made little sense even though the amounts were abundant at that time.In fact,this situation is similar to the investigation in the Republic of China.Generally speaking,for one thing,it is true that the non-independent of legal authority should be responsible for this undesired consequence,for another thing,the causes are also related to the scattered materials and the rising of right talk.Actually,the value of civil and commercial custom is not own to its effects on the legislation,but for the possible function on the application of law.
