On The Indirect Possession System

Possession system has a long history,occupies an important position in property law.Along with the development of social economy,science and technology science technology progress,the public also in constant progress,possession from the original,simple,in fact,at the mercy of the relationship for the development of conceptual control,possession system of the abstract.Indirect possession system arises at the historic moment,in the legal relations had the very big development space.Possession system originated in Roman law with Germanic law,indirect possession system shall be established in the "German civil code".For possession of property law system in our country the provisions of article only a few,the indirect possession system has yet to make that clear,and legal scholars in our country for indirect possession system of disputed problem,no agreement.Therefore,for the further research of indirect possession system is indispensable.Methods such as comparison method,this paper research,historical research on system of indirect possession,this paper explores the hope can demonstrate indirect possession system there are other irreplaceable role and function.The first part of this article explain the origin of indirect possession system by using the method of comparative law and legislative cases in different countries,showing different countries on different aspects of the system of indirect possession.The second part of the nature of the talk about the nature of the possession and indirect possession and function,and to describe academic debate for indirect possession system.The third part studies the indirect possession and the related real right system,for example,property law,aging and so on.The fourth part studies the reflection of indirect possession system,and build this system in civil law.In this paper,by analyzing shows that the function of indirect possession system in property law is objective existence,is not a dispensable,in effect,has a book indispensable value,and it is also necessary to protect the indirect possessor.Therefore,the author thinks that the indirect possession system in property law in our country have very big development space.
