The imaginative joiner of offenses is clearly defined in the Penal Code of Germany,Japan and China's Taiwan region,but it is not legislated in China's mainland criminal law,being full of controversial about the essence of the number of crimes and the principle of punishment of these two key points.The imaginative joiner of offenses is not transplanted from foreign,actually in ancient and modern Chinese criminal law it has a long history.The imaginative joiner of offenses is not transplanted from foreign,actually in ancient and modern Chinese criminal law it has a long history,which is related to current criminal law of our country.Therefore,it is necessary to sort out and summarize the ancient and modern,Chinese and foreign,legislative practice and the theories of it to draw a reasonable conclusion which is suitable for the reality of Chinese criminal law based on the essential characteristics of several crimes and the punishment principle of the imaginative joiner of offenses.It is a good way to develop Chinese the imaginative joiner of offenses.This paper mainly discusses the problem of the imaginative joiner of offenses from the following aspects: first,introducing the imaginative joiner of offenses from Germany,Japan,China's Taiwan region and China's mainland and reviewing the content about the number of crimes in ancient and modern Chinese criminal law;secondly the essential features of several crimes of the imaginative joiner of offenses is established;thirdly the imaginative joiner of offenses should be punished by the principle of combining several crimes for punishment.
